These Terms set out the rules for using our website, placing orders, and interacting with Torqhead LTD online. By accessing our site or making a purchase, you agree to comply with these Terms. Please read them carefully, as they outline your rights, responsibilities, and the conditions under which we provide our products and services.
This website is operated by TorqHead LTD. The terms “we”, “us”, "TH LTD", "TH", and “our” refer to TorqHead LTD. The use of our website is subject to the following terms and conditions of use, as amended from time to time (the “Terms”). The Terms are to be read together by you with any terms, conditions or disclaimers provided in the pages of our website. Please review the Terms carefully. The Terms apply to all users of our website, including without limitation, users who are browsers, customers, merchants, vendors and/or contributors of content. If you access and use this website, you accept and agree to be bound by and comply with the Terms and our Privacy Policy. If you do not agree to the Terms or our Privacy Policy, you are not authorized to access our website, use any of our website’s services or place an order on our website.
You agree to use our website for legitimate purposes and not for any illegal or unauthorized purpose, including without limitation, in violation of any intellectual property or privacy law. By agreeing to the Terms, you represent and warrant that you are at least the age of majority in your state or province of residence and are legally capable of entering into a binding contract. You agree to not use our website to conduct any activity that would constitute a civil or criminal offence or violate any law. You agree not to attempt to interfere with our website’s network or security features or to gain unauthorized access to our systems. You agree to provide us with accurate personal information, such as your email address, mailing address and other contact details in order to complete your order or contact you as needed. You agree to promptly update your account and information. You authorize us to collect and use this information to contact you in accordance with our Privacy Policy.
We reserve the right to refuse service to anyone, at any time, for any reason. We reserve the right to make any modifications to the website, including terminating, changing, suspending or dis-continuing any aspect of the website at any time, without notice. We may impose additional rules or limits on the use of our website. You agree to review the Terms regularly and your continued access or use of our website will mean that you agree to any changes. You agree that we will not be liable to you or any third party for any modification, suspension or discontinuance of our website or for any service, content, feature or product offered through our website.
All purchases through our website are subject to product availability. We may, in our sole discretion, limit or cancel the quantities offered on our website or limit the sales of our products or services to any person, household, geographic region or jurisdiction. Prices for our products are subject to change, without notice. Unless otherwise indicated, prices displayed on our website are quoted in American dollars (USD). We reserve the right, in our sole discretion, to refuse orders, including without limitation, orders that appear to be placed by distributors or resellers. If we believe that you have made a false or fraudulent order, we will be entitled to cancel the order and inform the relevant authorities. We do not guarantee the accuracy of the color or design of the products on our website. We have made efforts to ensure the color and design of our products are displayed as accurately as possible on our website.
5.1 By pre-ordering any product, you are authorizing Torqhead LTD to automatically charge you the amount (Deposit or Full) immediately upon submitting the pre-order. The amount you pay will be held with TH LTD as a Non-Refundable Deposit (NRD). The NRD amount is clearly shown on the product webpage. Any NRD collected may be transferable at the discretion of TH LTD.
5.2 The release date or shipping date of the product is determined by TH Limited, and it is specified on the product webpage or pre-ordering details webpage as an estimation of when the product will be available. Availability of the product on or before the release/shipment date is not guaranteed. Standard delivery time as outlined in the delivery policy are overruled by Pre-Order release date or shipping date.
5.3 You agree to forfeit to TH Limited the NRD in any event, except if the product becomes Not Available if TH Limited, at its sole discretion determines it will never be able to release the product. Delays in release of the Product by TH Limited or distributors do not result in the product becoming Not Available.
5.4 Remaining Balance: In the case of placing a deposit only for a Pre-Ordered product, you agree to pay the balance of your order + any other applicable fees within one [1] week of receiving the remaining balance invoice. Your product will not be delivered to you unless the remaining balance owing is paid in full. You agree that if you do not pay this balance within the one [1] week time limit that your product will be forfeited, restocked by TH Limited, and can be sold to other awaiting customers.
Links from or to websites outside our website are meant for convenience only. We do not review, endorse, approve or control, and are not responsible for any sites linked from or to our website, the content of those sites, the third parties named therein, or their products and services. Linking to any other site is at your sole risk and we will not be responsible or liable for any damages in connection with linking. Links to downloadable software sites are for convenience only and we are not responsible or liable for any difficulties or consequences associated with downloading the software. Our failure to exercise or enforce any right or provision of the Terms will not constitute a waiver of such right or provision. A waiver by us of any default will not constitute a waiver of any subsequent default. No waiver by us is effective unless it is communicated to you in writing.

If any of the provisions of the Terms are determined by any competent authority to be invalid, unlawful or unenforceable, such provision will to that extent be severed from the remaining Terms, which will continue to be valid and enforceable to the fullest extent permitted by law.
Any disputes arising out of or relating to the Terms, the Privacy Policy, use of our website, or our products or services offered on our website will be resolved in accordance with the laws of the Province of Ontario without regard to its conflict of law rules. Any disputes, actions or proceedings relating to the Terms or your access to or use of our website must be brought before the courts of the Province of Ontario in the City of London, Ontario and you irrevocably consent to the exclusive jurisdiction and venue of such courts.

Privacy Policy
We are committed to maintaining the accuracy, confidentiality, and security of your personally identifiable information ("Personal Information"). As part of this commitment, our privacy policy governs our actions as they relate to the collection, use and disclosure of Personal Information. Our privacy policy is based upon the values set by the Canadian Standards Association's Model Code for the Protection of Personal Information and Canada's Personal Information Protection and Electronic Documents Act.
We are responsible for maintaining and protecting the Personal Information under our control. We have designated an individual or individuals who is/are responsible for compliance with our privacy policy.
We collect, use and disclose Personal Information to provide you with the product or service you have requested and to offer you additional products and services we believe you might be interested in. The purposes for which we collect Personal Information will be identified before or at the time we collect the information. In certain circumstances, the purposes for which information is collected may be clear, and consent may be implied, such as where your name, address and payment information is provided as part of the order process.
Knowledge and consent are required for the collection, use or disclosure of Personal Information except where required or permitted by law. Providing us with your Personal Information is always your choice. However, your decision not to provide certain information may limit our ability to provide you with our products or services. We will not require you to consent to the collection, use, or disclosure of information as a condition to the supply of a product or service, except as required to be able to supply the product or service.
The Personal Information collected will be limited to those details necessary for the purposes identified by us. With your consent, we may collect Personal Information from you in person, over the telephone or by corresponding with you via mail, facsimile, or the Internet.
Personal Information may only be used or disclosed for the purpose for which it was collected unless you have otherwise consented, or when it is required or permitted by law. Personal Information will only be retained for the period of time required to fulfill the purpose for which we collected it or as may be required by law.
Personal Information will be maintained in as accurate, complete and up-to-date form as is necessary to fulfill the purposes for which it is to be used.
Personal Information will be protected by security safeguards that are appropriate to the sensitivity level of the information. We take all reasonable precautions to protect your Personal Information from any loss or unauthorized use, access or disclosure.
We will make information available to you about our policies and practices with respect to the management of your Personal Information.
Upon request, you will be informed of the existence, use and disclosure of your Personal Information, and will be given access to it. You may verify the accuracy and completeness of your Personal Information, and may request that it be amended, if appropriate. However, in certain circumstances permitted by law, we will not disclose certain information to you. For example, we may not disclose information relating to you if other individuals are referenced or if there are legal, security or commercial proprietary restrictions.

We may use cookies to improve our website’s functionality and in some cases, to provide visitors with a customized online experience. Cookies are widely used and most web browsers are configured initially to accept cookies automatically. You may change your Internet browser settings to prevent your computer from accepting cookies or to notify you when you receive a cookie so that you may decline its acceptance. Please note, however, if you disable cookies, you may not experience optimal performance of our website. Other Websites Our website may contain links to other third party sites that are not governed by this privacy policy. Although we endeavor to only link to sites with high privacy standards, our privacy policy will no longer apply once you leave our website. Additionally, we are not responsible for the privacy practices employed by third party websites. Therefore, we suggest that you examine the privacy statements of those sites to learn how your information may be collected, used, shared and disclosed.
Privacy policy for our apps
The sections above cover our website and online store. The sections below cover the two pieces of software we provide with the LT-DIS ignition system: the LT-DIS mobile app for iOS and Android, which connects to your dash module over Bluetooth to display live engine data and diagnostics, and LTDIS Toolkit for Windows and macOS, which updates the firmware on an LT-DIS unit connected by USB. Where these sections and the sections above differ on a point about the apps, these sections apply.
Neither app has an account or a login, and we do not ask for your name, email address or payment details in either one. Neither app contains advertising, analytics or tracking tools of any kind.
While your phone is connected to an LT-DIS module, the mobile app receives and displays data from that module, including engine speed, ignition advance, current and peak system temperature, coil, system and FPGA supply voltages, crank and cam sensor counts and error counts, system run hours, installed firmware versions, diagnostic trouble codes, and readings from any auxiliary sensors you have configured. Some of this data is sent to us automatically, as set out in section 5.
The mobile app uses your device's GPS and sends your latitude, longitude, altitude and speed to us as part of the diagnostic reports described in section 5. We use it for two things.
The first is to determine the outside air temperature your engine was running in. A temperature reading only means something relative to ambient conditions: 95°C on a winter morning indicates a developing fault, while the same reading in desert heat is normal. Establishing the ambient temperature a reading was taken in is what makes overheat detection possible. The second is the optional on-screen speedometer, which reads your speed directly from GPS.
We do not keep your location. When a report reaches our server, the coordinates are used immediately to look up the outside air temperature at that place and time. We store that temperature against your unit's record, and the coordinates are discarded in the same operation. They are not written to our database, and we cannot reconstruct where you were from what we keep.
Location is required for temperature monitoring to work. It is part of how the LT-DIS protects your engine, so the app does not offer a setting to send diagnostic reports without it. You may deny or revoke the location permission in your device's settings, and the app will still connect to your unit and display live data, trouble codes and logs, but we will not be able to interpret the temperature data we receive, and the speedometer will not work. We never collect your location while you are not using the app, and we never use it for advertising, for mapping your trips, or for any purpose unrelated to interpreting engine data.
The mobile app collects and sends us the Bluetooth name and Bluetooth identifier of your LT-DIS dash module; the hardware serial number and manufacturer signature held in your LT-DIS unit, which we use to confirm the unit is genuine; a randomly generated installation identifier created by the app on first use, which is not derived from your phone's hardware identifiers; and an access key our server issues to your installation once your unit is confirmed genuine.
These identify a unit and an installation rather than a person. If you purchased your LT-DIS directly from us, we may be able to connect a serial number to your order record.
The mobile app can record a running log of the raw data stream from your LT-DIS. That log stays on your phone unless you tap the send button and confirm, which uploads it to us together with your module's name and identifier so that our support team can review it with you. A separate Bluetooth debug log, available in developer settings, is written to a file on your device and is only ever shared if you export it yourself.
Automatically. Your unit's serial number and signature are sent each time the app or the Toolkit connects to a unit, which is required to confirm the unit is genuine. An engine summary, consisting of peak and current temperature, engine speed, run hours and auxiliary sensor readings, together with your module identifiers and the location information described in section 2, is sent once each time you connect, and again when peak temperature rises, when a temperature warning threshold is crossed, or when a tracked auxiliary sensor changes.
Only when you choose. A full data log is sent only when you tap send and confirm. The Bluetooth debug log is sent only if you export and share it yourself.
Safety and reliability. Overheating and sensor faults are the failures that damage engines. Temperature and fault data allows us to identify a developing problem, both in your unit and across units in the field.
Support and warranty. When you contact us about a problem, the diagnostic history for your unit is what allows us to answer usefully.
Product improvement. Aggregate data on how the system behaves in real vehicles informs our firmware and hardware revisions.
Protection against counterfeits. Verifying hardware certificates and logging firmware requests prevents unauthorised copies of our hardware from being flashed with our firmware.
We do not use any of it for advertising, profiling or marketing, and we do not sell it.
Neither app collects your name, email address, phone number or postal address, and neither has an account, login or registration. Neither app accesses your contacts, photos, calendar, microphone, camera or files. Neither app collects advertising identifiers, and neither contains advertising or analytics software. The mobile app requests location only while you are using it, and never in the background.
When you download firmware for your unit, the Toolkit reads the hardware serial number and signature from the connected LT-DIS and sends them to our server to confirm the unit is genuine. We record the serial number, the firmware requested, whether the signature was valid, the IP address of the request and the time it was made. We keep these records to detect counterfeit units, which typically appear as one serial number requesting firmware from many different machines.
The Toolkit does not collect location data, and does not read anything from your computer beyond what is required to communicate with a connected LT-DIS unit.
The mobile app keeps a local database on your phone holding your settings, your saved LT-DIS pairing, the trouble-code reference list and your recorded data logs. Your access key is stored in the iOS Keychain or the Android Keystore. All of it is removed when you uninstall the app. You can clear a saved pairing at any time using the "Forget" button in Settings, and clear recorded logs from the log screen.
Our servers and databases run on Microsoft Azure. Microsoft processes this data on our instructions as our service provider and has no independent right to use it. We do not sell, rent or trade this data, and we do not share it for anyone else's marketing. We may disclose it where required by law, a court order or a lawful request from a public authority, and it may transfer to an acquirer if TorqHead LTD is sold or merged, under this same policy.
TorqHead LTD is based in St Thomas, Ontario, and our staff access this data from Canada. Depending on the Azure region serving your data, it is stored and processed in Canada or the United States, and both countries permit government authorities to seek access to data held there under their own legal process. For users in the European Economic Area and the United Kingdom, transfers to Canada rely on the European Commission's partial adequacy decision covering Canadian commercial organisations; where data is processed in the United States by Microsoft as our hosting provider, that transfer relies on Microsoft's standard contractual clauses and its certification under the EU–US and UK–US Data Privacy Framework.
Location coordinates are not retained at all, as described in section 2. Diagnostic and engine reports are kept for 24 months from the date received. Data logs you send to support are kept for 24 months, or longer where attached to an open warranty claim. Firmware download and authentication records are kept for 24 months, as these are our counterfeit-detection records. We delete or anonymise data once it is no longer needed for the purpose it was collected for, or for a legal or warranty obligation.
All data sent between the apps and our servers travels over encrypted HTTPS connections. Access keys are held in your device's Keychain or Keystore. Each LT-DIS carries a cryptographic certificate signed during manufacturing, which our server verifies independently before accepting data or releasing firmware. Access to stored data is limited to personnel who need it to support customers or improve the product.
No system is perfectly secure and we cannot guarantee absolute security. If a breach affecting your data creates a real risk of significant harm, we will notify you and the Office of the Privacy Commissioner of Canada as required by law.
Bluetooth is required, and is used to find and connect to your LT-DIS dash module. We do not scan for or record other Bluetooth devices around you.
Location is required for temperature monitoring and the speedometer, for the reasons given in section 2. On Android, the operating system has also historically tied Bluetooth scanning to the location permission.
Network access is required, and is used to verify your unit and send diagnostic reports.
Under Canada's Personal Information Protection and Electronic Documents Act, and under the GDPR and UK GDPR if you are in the European Economic Area or the United Kingdom, you may ask what data we hold relating to you or your unit and receive a copy of it; ask us to correct data that is wrong; ask us to delete it, subject to records we are required to keep; withdraw your consent on notice, for which revoking the location permission or uninstalling the app is the most direct means; and, in the EEA and UK, ask us to restrict or object to certain processing and receive your data in a portable format.
To make a request, email sales@torqhead.com with "Privacy request" in the subject line. Because the apps have no accounts, please include your LT-DIS serial number or the Bluetooth name of your module so that we can locate the right records. We respond within 30 days. You may also complain to the Office of the Privacy Commissioner of Canada at priv.gc.ca, or to your national data protection authority in the EEA or the UK.

Our apps are tools for installing and maintaining automotive hardware and are not directed at children. We do not knowingly collect data from anyone under 13. If you believe a child has provided us with data, contact us and we will delete it.
If we change how we handle data, we will update these sections and the date shown below. For a significant change, such as collecting something new or using data for a new purpose, we will give notice in the app before the change takes effect.
