Will I have to pay cross border tariff charges?
Updated March 19, 2025.
Tariff charges are separate and on top of transportation charges. They apply for orders costing more than $800 USD (see de minimis exemption note below). The rate and amount of these tariffs is levied by the US Government and is a cost to the end consumer. As of March 19, 2025 torqhead will no longer be responsible for calculating, charging and pre-billing these tarrif charges at time of checkout. Necessary tariff costs (customs, brokerage, duty, tax and other cross border importation charges) based on the date the product crosses the border are the sole responsibility of the end customer. The end customer will need to pay these charges to Fedex/US Customs prior to fedex delivering the package. So please be monitoring for phone calls or email notifications from Fedex while you track the delivery of your package. Fedex has a customer payment portal https://www.fedex.com/paynow/payment . You will be able to enter your tracking # and pay online.
If a package does not have its tariff charges paid, this will cause delays to your deliver and/or it being returned to shipper. If a package is returned to Torqhead due to unpaid delivery tariffs you will be charged for the cost of the 'return to shipper' fee and also charged to re-shipping the package.
Current Tariff Rates: The majority of Torqhead LTD products are USMCA compliant as they are produced/assembled in Canada. Currently as long as products are USMCA compliant then the tariff rate is 0% (this might change on April 2nd USA announcement). We submit the documentation of USMCA country of origin with each shipment. Please note however that US CBP are ultimately responsible for determination of tariff charges. Even at 0% tariff for USCMA compliant product there will still be some fee's associated with cross border shipment. As an example it might be $80-90USD on full kit.
The de minimis exemption law. The "$800 Rule". US customs section 321(a)(2)(C) Tariff Act of 1930. This is a law that allows shipments valued at or below US$800 per person, per day to enter the united states duty and tax free (no tariff charges). Torqhead will not charge tariffs on orders/shipments that are of US$800 or less that are delivered to the USA. We will only charge, and be responsible for, transportation costs only. We always have and will prepare a formal entry to US CBP for the item as per new 2025 rules regarding the de minimis exemption.
NOTE!!: The de minimis exception may also be removed by the White House administration in coming weeks/months. If this is the case, there will no longer be excemptions and customers will be charged tariffs on any and all values of product. We will monitor closely, and update here if necessary.
If you have any questions please feel free to reach out. We would be glad to provide you guidance on cross border related fees and tariffs.
We look forward to 2025 and many years to come. Exciting new products are in the works for 2025+. We love to support LT1/LT4 engines and their owners on both sides of the border and around the world.
